Terms and Conditions

Eligibility: In order to participate in the Omaha Pro Select Training & Tournament Sweepstakes (the “Sweepstakes” or the “Promotion”), you must be at least thirteen (13) years of age and a legal U.S. resident who resides in one of the 50 U.S. states or Puerto Rico (Promotion void elsewhere). The Grand Prize winner will be declared an Event Participant and allowed to attend the Omaha Pro Select Training & Tournament for free as long as the entrant meets the following Qualifications:

Qualifications:

1. Event participant must be between the ages of thirteen (13) to eighteen (18)

2. Event participant must qualify for the event based on the event participant’s baseball ability. The entrant’s baseball ability must be determined by Baseball Factory at a prior Baseball Factory event, or the entrant’s baseball ability must be confirmed by a source approved by Baseball Factory. Ultimately, it is in Baseball Factory’s full discretion to determine the baseball ability of the player and allow or disallow participation by the entrant or the entrant’s assigned event participant.

3. Event participant must obtain and pay for travel to and from the Omaha Pro Select Training & Tournament. Once in Omaha for the event, Baseball Factory will transport the player to and from the event location, airport, train station and other necessary facilities during the event. Baseball Factory will also cover all food and rooming costs for the player while an Event Participant. Travel arrangements to get the Event Participant to and from the Omaha Pro Select Training & Tournament must be confirmed with Baseball Factory prior to the entrant accepting the Grand Prize. If the entrant is unable to obtain transportation to and from the event, the Grand Prize will be randomly drawn again and a new Grand Prize winner will be named.

If an entrant is older than eighteen (18) they are allowed to enter the Sweepstakes, but are not allowed to accept the Grand Prize. If someone older than eighteen (18) wins the Sweepstakes, they will be allowed to transfer the Grand Prize to a baseball player age thirteen (13) to eighteen (18) that meets the Qualifications listed above as part of the Terms and Conditions. This transfer can be made to a sibling, child, friend, teammate, or any other baseball player of their choice that meets the above Qualifications.

An entrant is ineligible for the Grand Prize if they have already registered to attend the Omaha Pro Select Training & Tournament; however, they may transfer the Grand Prize to a sibling, friend, teammate or other baseball player of their choice that meets the above Qualifications. The Grand Prize may not be substituted as a form of payment for a registered participant in the Omaha Pro Select Training & Tournament or transferred to a registered participant in the Omaha Pro Select Training & Tournament and used as a form of payment.

By entering, each entrant acknowledges acceptance of and compliance with these official rules (the “Terms and Conditions”).

How to Enter: Sweepstakes begins on 4/30/10 and ends on 5/21/10. Entries must be received during the entry period to be eligible for the random drawing for the Grand Prize. There is one way to participate and that is Online. To enter the Sweepstakes, visit www.baseballfactory.com and complete the entry form. The entry form requires the entrant to provide contact information so that they can be identified if selected as the Grand Prize winner. This information is also required to receive the free DVD that all entrants will receive for submitting a completed entry form. A completed entry form includes the contact information for the entrant, and also select contact information for at least three (3) players that the entrant refers to Baseball Factory. By referring these players, the entrant is stating that they have informed these players that their contact information has been provided to Baseball Factory and that they are opting in to be contacted by Baseball Factory regarding events and other promotions. All contact info, both of the entrant and the referred players will be governed by the Baseball Factory privacy policy, which can be found on the Baseball Factory home page (www.baseballfactory.com).

In order for an entry form to be accepted and considered complete, the information provided for both the entrant and referred players must be accurate. If contact information provided for either the entrant of the referred players is incorrect, the entrant will not be eligible for the Grand Prize or the free DVD.

Free DVD Rules: All confirmed and qualified entrants will receive a free DVD from Baseball Factory. This DVD will be the MLS Training for Baseball VOL 3: Speed & Agility DVD. The free DVD has a maximum $30 value and will be sent to each confirmed entrant within four (4) weeks of submitting the entry form.

Conditions & Limitations: NO PURCHASE NECESSARY TO ENTER SWEEPSTAKES. Void where prohibited. Starts 4/30/10. Restrictions apply. Omaha Pro Select Training & Tournament Sweepstakes entry ends on 5/21/10. (1) Grand Prize winner selected from all entries. Winner will be selected randomly from all entries submitted and will be announce by 6/1/10. Maximum prize value: $3,699.

Acceptance of a prize constitutes permission from the winner to the Baseball Factory and its sponsors to use such winner’s name and/or likeness for advertising and publicity purposes, without further compensation, except where such use is prohibited by law. By entering, each entrant agrees to hold harmless and indemnify the Baseball Factory and its subsidiaries, affiliates, directors, officers, employees and agents, its advertising/promotions agencies, participating retailers, and their respective subsidiaries, affiliates, directors, offices, employees, agents and suppliers, against any and all liability, damages or causes of action (however named or described) due to any injuries, theft, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from (a) acceptance, receipt, possession, misuse or use of any prize; (b) participation in any Sweepstakes-related activity or participation in this Sweepstakes; (c) any malfunction of the entry website; (d) any error in the collection or retention of entry information; or (e) any typographical or other error in the printing, offering or announcement of any prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participating in this Sweepstakes or use or redemption of any prize.
